Sexual Misconduct Policy
This Policy prohibits all forms of sexual or gender-based harassment and misconduct, including sexual assault, non-consensual sexual contact, intimate partner violence, sexual exploitation, and stalking. This Policy also prohibits retaliation against a person who reports, complains about, or who otherwise participates in good faith in, any matter related to this Policy. Union College's Sexual Misconduct Policy applies to all members of the Union College community.
Appendix A: Resolution of a Complaint against a Student
The Sexual Misconduct Adjudication Process is the adjudication process applicable to complaints against Union College students accused of sexual misconduct (including sex or gender-based discrimination or harassment; sexual misconduct; and intimate partner violence (including domestic and dating violence). As outlined in the Sexual Misconduct Policy, an individual who wishes to make a report of sexual or other prohibited conduct is encouraged to make a report directly to the Title IX Coordinator, the Dean of Students Office, or Campus Safety. In every instance under this policy, the College, through the coordinated efforts of the Title IX Coordinator will conduct an initial Title IX Assessment will make an immediate assessment of imminent risk to the individual or the campus community and respond accordingly.
Appendix B: Resolution of a Complaint against a Faculty Member
Based on federal law, specifically Title IX and the Violence Against Women Act (VAWA), accompanying federal regulations, and guidance issued by the U.S. Departments of Education and Justice, and Article 129-B of the New York State Education Law, the following procedures apply in cases where a formal complaint of a violation of the College’s Sexual Misconduct Policy has been interposed against a Faculty member. These procedures supersede those described in the Union College’s Procedures for Dismissal and Sanctions found in the Faculty Manual.
Appendix C: Resolution of a Complaint against an Employee
As outlined in the Union College Sexual Misconduct Policy, an individual who wishes to make a report of sexual misconduct or other prohibited conduct is encouraged to make a report directly to the Title IX Coordinator or Campus Safety. Additionally, employees are encouraged to report such conduct to their immediate supervisor or directly to Human Resources. In every instance under this policy, the College, through the coordinated efforts of the Title IX Coordinator, will conduct an initial Title IX Assessment and will make an immediate assessment of imminent risk to the individual or the campus community and respond accordingly.
Union College guidance for the union college community during the time of covid-19 with respect to the college's sexual misconduct policy
To protect the safety of students and campus personnel from the novel coronavirus and the COVID-19 outbreak, Union College has followed the guidance of government and public health leaders to reduce density and in-person interactions on its campus. During these unprecedented times, the College continues to serve the campus community.
